Machakos County CID boss Henry Ndombi, summoned the Women Rep on Friday to record a statement over the remarks. According to Ndombi, Musyoka's sentiments amounted to treason which is punishable by death. “There is an indication that she will be charged with treason under section 40 of the penal code, which is actually a very old law that Parliament should have amended in line with the new constitution," Ndombi told a local daily.
However, the Women Rep failed to turn up and sent her lawyer Daniel Maanzo, who claimed she could not make it since she had gone to hospital. Maanzo, dismissed the treason charges stating that they would not even stand in court.
The lawyer added that her arrest was politically motivated by a local politician and questioned why no action had been taken against politicians who uttered such statements. “It was just the other day when we heard another leader saying he was the third in command and no action has ever been taken on him.

On Tuesday, Musyoka addressed the media in Machakos town where she complained that the unending cases of public funds being lost are “becoming completely intolerable”. She went on to sarcastically advise the head of state to “resign or commit suicide for not tackling corruption”.
A section of leaders affiliated to Jubilee had called for Musyoka's arrest stating that she had disrespected the Head of State.
